1. Agreement to Terms

By accessing or using Temperature Tom's services (temperaturetom.com), you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all users including homeowners and HVAC contractors.

2. Service Description

Temperature Tom is a pay-per-lead HVAC lead generation platform operating in New Jersey. We connect homeowners seeking HVAC services with licensed, local HVAC contractors. Our service is free for homeowners. Contractors pay a per-lead fee as disclosed at signup.

3. Contractor Terms

• Each lead is exclusive — it is delivered to one contractor only and may not be resold or shared.
• The per-lead fee is charged to your payment method on file at time of lead delivery.
• Your first 5 leads are complimentary. After that, standard per-lead pricing applies.
• You must contact all delivered leads within 24 hours.
• Disputes must be submitted within 48 hours of lead delivery via the contractor portal.
• Approved disputes may result in lead replacement credits at our sole discretion.
• We reserve the right to pause or terminate accounts for abuse, fraudulent chargebacks, or violation of these terms.
• You are responsible for maintaining valid licenses and insurance as required by New Jersey law.

4. Homeowner Terms

• The service is completely free for homeowners.
• By submitting a lead request, you consent to being contacted by HVAC contractors via phone, text, or email.
• We match you with one local contractor. You have no obligation to hire them.
• Contractor quality is not guaranteed. We vet contractors but are not liable for their work.

5. Payments & Refunds

Payments are processed via Stripe. By providing payment information, you authorize us to charge your payment method for leads delivered. All charges are non-refundable except as provided in our dispute policy. Disputed leads are reviewed on a case-by-case basis and may result in replacement credits (not cash refunds) at our discretion.

6. SMS Terms & Conditions

Program Name: Temperature Tom HVAC Service Alerts

Program Description: Temperature Tom sends transactional SMS messages to homeowners and HVAC contractors. Homeowners receive service request confirmations, follow-up messages, job completion checks, and review requests. Contractors receive lead assignment notifications, call reminders, onboarding messages, and account alerts.

Message Frequency: Message frequency varies. Homeowners typically receive 1–5 messages per service request. Contractors typically receive 1–10 messages per week depending on lead volume and account activity.

Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan. Temperature Tom does not charge for SMS messages.

Opt-Out: You can opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a single confirmation message and no further SMS messages will be sent.

Carriers are not liable for delayed or undelivered messages. By opting in to SMS, you agree to these SMS terms.

7. CAN-SPAM Compliance

All commercial email communications from Temperature Tom comply with the CAN-SPAM Act. Each email includes our physical address, a clear subject line, and an unsubscribe mechanism. To unsubscribe from marketing emails, reply to any email with "unsubscribe" or email tom@temperaturetom.com. Transactional emails (lead delivery, account confirmations) cannot be opted out of while maintaining an active account.

8. Limitation of Liability

Temperature Tom is not liable for: the quality of work performed by any contractor; any damages arising from a contractor-homeowner relationship; loss of profits or business; or any indirect, incidental, or consequential damages. Our total liability is limited to the amount paid by the party making the claim in the 30 days prior to the dispute.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of New Jersey.

10. Changes to Terms

We may update these Terms at any time. Continued use of our service after changes constitutes acceptance of the new Terms. We will notify active contractors of material changes via email.
